Terms of Use

Agreement

These Terms of Use apply to the SPARK mobile, tablet, and web applications. By downloading, accessing, or using SPARK, you agree to these Terms. If you do not agree, do not use SPARK.

If you are not old enough to agree to these Terms where you live, a parent or legal guardian must review and agree to them for you. Adults who configure SPARK for another person are responsible for doing so with appropriate authority and care.

Who provides SPARK

SPARK is provided by its founders, Shreyas Jain and Catelyn Dao. Contact us at contact@spark4speech.com.

Permission to use the app

Subject to these Terms and the applicable app-store license, SPARK grants you a limited, personal, non-exclusive, non-transferable, revocable right to use the compiled application for lawful communication, education, accessibility, and personal support purposes.

SPARK's source code, name, logo, and first-party materials are proprietary unless a separate written license says otherwise. Third-party software and artwork remain governed by their own licenses and notices.

Your content

You keep your rights in messages, photos, recordings, custom vocabulary, and other content you add to SPARK. SPARK does not need a license to upload or host that content because ordinary app use keeps it on your device.

You are responsible for having the rights and permissions needed for content you add, export, or share. You are also responsible for your backups. SPARK cannot restore local data that was deleted without a backup.

Appropriate use

• Do not use SPARK in a way that violates law or another person's rights.
• Do not attempt to interfere with, overload, probe, or bypass security of the public web service.
• Do not falsely suggest that SPARK or its founders endorse you or your content.
• Do not remove proprietary or third-party notices from copies you are authorized to distribute.

Communication and safety

SPARK is an assistive communication tool, not an emergency service. Speech output, prediction, device voices, backups, and other features can fail or behave differently across devices. Keep another way to request urgent help when needed.

SPARK does not provide medical, diagnostic, therapeutic, legal, or other professional advice and is not a substitute for professional judgment. The app may support a communication plan, but it does not guarantee a particular health, education, or communication outcome.

Availability and changes

We may fix, change, suspend, or discontinue features. We aim to keep core communication available offline, but we do not promise that every feature will work on every device or remain available forever. Public web access also depends on internet and hosting services.

Third-party services and materials

Device speech voices, operating-system pickers and sharing, app stores, web hosting, and any destination you choose for an export are provided by third parties under their own terms. SPARK also includes third-party open-source software and symbol resources identified in its Licenses and Attributions notice.

Disclaimers

To the fullest extent permitted by law, SPARK is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, or error-free results. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

Limits on liability

To the fullest extent permitted by law, SPARK, its founders, contributors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, communications, opportunity, or profits arising from SPARK.

To the fullest extent permitted by law, their total liability for claims relating to SPARK will not exceed the greater of the amount you paid for SPARK in the 12 months before the claim or 100 U.S. dollars. These limits do not apply where law does not allow them.

App-store terms

If you obtained SPARK through an app store, that store's standard end-user license terms also apply. If these Terms conflict with mandatory app-store terms, the mandatory app-store terms control for that issue. Apple and Google are not responsible for support except as required by their terms or law.

Ending use and changes to these Terms

You may stop using SPARK at any time. We may restrict access to hosted services for a serious or repeated violation of these Terms, while respecting applicable law.

We may update these Terms when SPARK or legal requirements change. The effective date will be updated. Continued use after updated Terms take effect means you accept them where permitted by law.

General terms

Applicable law governs these Terms without overriding consumer protections that cannot be waived. If part of these Terms is unenforceable, the rest remains in effect. A failure to enforce a term is not a waiver. These Terms, the Privacy Policy, applicable app-store terms, and any written license are the entire agreement about your use of SPARK.
